The
bill (Reg. No. 6307) amends Clause 71 of the Law "On Pension
Provision", whereby the pension for the period of study of wards, pupils,
students, military students, auditors, trainees, residents, post-graduate
students and postdoctoral students is calculated due to the data of the
individual records in the system of compulsory state retirement insurance. The
government pays dues for compulsory state retirement insurance of the mentioned
persons enrolled on a full-time education under the procedure fixed by the
Cabinet of Ministers of Ukraine at the rate not less than the minimum wage.
Pursuant to the Law, only periods during which monthly insurance contributions at the rate not lower than the minimal insurance contribution are taken into consideration while calculating the pensionable service. Thereby, the periods of working activity and other periods that were referred to the record of service before the Law came into effect are included into the pensionable service in order and under conditions established by the legislation.
The Committee members emphasised that introduction of amendments to the Law "On Pension Insurance" that do not regulate this issue since 1 January 2004 is unacceptable.
As to clause 71 of the Law "On Pension Insurance", the Committee members admitted that it regulated the issues of the pension calculation for the educatees and was not related to the calculation of service record.
The Committee members declared that the Ministry of Finance considered it inappropriate to amend the Law "On Pension Insurance" on adoption of the Law "On Compulsory State Pension Insurance."
